SHOULD THE SOFTWARE OR ANY MANUALS PROVE TO BE DEFECTIVE, Live Software Inc., SHALL NOT BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THIS SOFTWARE. IN ADDITION, Live Software Inc. WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES OR ANY DIRECT DAMAGES OVER AND ABOVE THE PURCHASE PRICE OF THIS SOFTWARE. Live Software Inc., DOES NOT WARRANT THAT THE FUNCTION OF THIS SOFTWARE WILL BE ERROR-FREE.

MISCELLANEOUS:

8. This Agreement is governed by the laws of Canada. If any legal action is brought by Live Software Inc., regarding the breach of this License Agreement or in any other way to enforce this Agreement, Live Software Inc., shall be entitled to recover, in addition to any other relief, lost profits or lost sales of the software, other consequential damage, reasonable attorney fees, court costs and all other expenses of litigation. In the event that one or more of the provisions in this Agreement shall be held invalid by a court of competent jurisdiction, the remaining provisions shall nevertheless be valid.
